These Terms and Conditions apply to Waterwise Project Ltd’s individual membership programme (the "Membership") and the associated benefits provided as part of Membership. By joining, purchasing, or using the Membership, you agree to be bound by these Terms and Conditions. References to the Waterwise Project Ltd, we or us are references to the Board of Trustees of the Waterwise Project Ltd.
1. Membership Eligibility
To become a member of Waterwise Project Ltd (a Member), you must be at least 18 years old. Membership is available to individuals only and is non-transferable.
2. Membership Duration and Renewal
2.1 You can become a member by completing the registration process on our website and your membership is valid for 12 months from the date of activation unless otherwise stated.
2.2 Memberships automatically expire after 12 months from the date of purchase.
2.3 You will receive several reminders to renew your Membership prior to your renewal date.
3. Membership Benefits
3.1 A list of membership benefits can be found on the Membership sign up page.
Please note that Membership benefits may change from time to time. Waterwise Project reserves the right to modify, add, or remove benefits at its discretion.
4. Membership Fees and Payment
4.1 Membership fees are due and payable at the time of registration. You agree to pay the membership fee in full at the time of registration.
4.2 Membership fees for any renewal period are due and payable on the date of each renewal.
4.3 Membership fees are non-refundable except as outlined in clause 14.
4.4 We reserve the right to increase the price of your Membership subscription on an annual basis. If so you will be informed of any fee increase within your renewal notifications.
5. Administration of your Membership
5.1 Membership is administered almost exclusively through Waterwise Project‘s online channels.
5.2 We will send communications about your Membership to the email address associated with your account. You can unsubscribe from receiving emails at any time using the link included on emails sent to you. You can also change your email preferences by logging into your account and editing your preferences. How we use your personal data in relation to emailing you is dealt with in our Privacy Policy.
5.3 We cannot provide the membership service without a valid email address (or if you unsubscribe from receiving emails from us at any time).
6. Accessing Membership benefits
6.1 Membership benefits may be accessed by the named person only. Membership is personal and cannot be transferred to another person. Members are not permitted to allow another person to use their Membership and cannot sell, rent or otherwise monetise their Membership and/or its benefits.
7. Members’ Events
7.1 Should Waterwise run any Member Events these may require an extra cost in addition to the annual Membership fee. We reserve the right to cancel or rearrange Member events.
7.2 Tickets for both free and paid-for Member events will be available on a first-come, first-served basis and events will be limited by capacity, therefore attendance cannot be guaranteed to all Members and we recommend booking event tickets in advance. If you have booked a ticket but are subsequently unable to attend a particular event, we ask that you advise info@waterwise.org.uk as soon as possible so the place can be made available to another Member.
7.3 Members' tickets for paid events are non-refundable. Waterwise Project does not accept liability for any costs incurred by Members (e.g. travel) if Waterwise has to cancel an event due to unforeseen circumstances.
7.4 Waterwise is not responsible for the views or opinions expressed by individual speakers at Members’ events.
7.5 Unless permission requested and granted, photography and recording of Member events by attendees is not permitted in order to protect the privacy of the audience and speakers connected to the event.
7.6 Please note that our Member Events are
always subject to ticketing terms and conditions.
8. Member Conduct
8.1 As a Member, you agree to behave respectfully towards Waterwise staff and other members while participating in any Waterwise-related activities or events, online or in person. Any behaviour deemed disruptive, harmful, offensive or in violation of the Waterwise’s policies may result in suspension or termination of your membership and/or removal from events.
8.2 Waterwise reserves the right to suspend or cancel Membership, or conduct further investigations, if it becomes aware of or reasonably suspects that a Member has shared their membership or access details to allow others to use membership benefits.
8.3 If you are removed from a paid-for event or your Membership is terminated due to a breach of these terms and conditions, you will not receive a refund for the ticket price or your Membership.
9. Our right to cancel your Membership or refuse Membership benefits
9.1 Waterwise reserves the right not to fulfil or to cancel or suspend a Membership if you are found to be in breach of these terms and conditions or if we reasonably suspect you are in breach or will breach these terms and conditions.
9.2 On receipt of your order we will debit your card for the Membership fee (as applicable) at this point a contract, subject to these terms and conditions, will be formed between us.
9.3 If we are unable to obtain payment authorisation from the issuer of your card or from your bank, you forfeit any Membership benefits.
10. Credit/Debit card payments
10.1 The credit/debit card information you provide us for a Membership transaction is used solely for the purpose of processing that Membership transaction. If we are unable to process payment from the credit/debit card details you have provided we will contact you to verify your card details.
10.2 If you are not using your own credit/debit card to pay for the Membership subscription, you must have the permission of the credit/debit card holder before entering payment details. When you subscribe to Membership of Waterwise Project Ltd online, you are confirming that you have obtained the express prior permission of the credit/debit card holder.
11. Your right to cancel
11.1 You may cancel your membership at any time by emailing us at info@waterwise.org.uk or by not renewing (please note: unsubscribing from newsletters etc will not cancel your membership). We do not offer refunds for Membership fees already paid.
11.2 If you purchase Membership online, you have a legal right to cancel the contract formed between us (and receive a refund of the Membership fees paid) provided that you inform us you wish to cancel within 14 days from the date on which we confirm that your order for Membership has been confirmed and you have not used your Membership before cancellation. After this 14-day period has elapsed, you will not be able to cancel your Membership and receive a refund. To cancel your Membership as set out in this clause please contact us via e-mail at info@waterwise.uk.
11.3 If you cancel the contract in accordance with clause 11.2 within 14 days, we will refund you the price you paid for the Membership. By using your Membership benefits you waive your right to a refund on cancellation.
12. When your Membership expires
After expiry or cancellation of your Membership, you will continue to receive non-member email updates from us to let you know what is happening at Waterwise and giving you the opportunity to renew your Membership. If you do not wish to hear from Waterwise after your Membership expires, please unsubscribe by via the footer in any email from Waterwise.
13. Privacy and Data Protection
When you purchase Membership, it will be necessary for us to obtain from you and process certain information (such as your name, address, email, etc.) which we will treat as “personal data” for the purposes of data protection law. We take your privacy seriously and will only process your personal data in accordance with the law and our Privacy Policy.
14. Liability
14.1 Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by the Waterwise’s negligence (or that of its staff, employees or agents) or for fraud or fraudulent misrepresentation or for any other liability that cannot be excluded or limited by law.
14.2 Subject to clause 14.1, Waterwise shall not be liable (howsoever arising and whether for breach of contract, negligence or for any other reason) to Members or to any other third party for: (a) any loss or damage to personal property that may occur while attending Waterwise events, or activities; and (b) any loss of profit, loss of sales, loss of revenue or any special, incidental, indirect or consequential loss.
14.3 Subject to clauses 14.1and 14.2, the total liability of Waterwise for anything that it has done or not done under or in connection with these terms and conditions (and whether the liability arises because of breach of contract, negligence or for any other reason) is limited to an amount equal to the annual Membership Fee paid or payable during the year in which the cause of action arose.
15. Changes to Terms and Conditions and Membership
We reserve the right to amend these Terms and Conditions, your Membership and Membership Benefits at any time. Your continued use of the Membership after any such changes constitutes your acceptance of the new Terms and Conditions. You will be notified of any significant changes to your Membership via email.
16. Waterwise Project Ltd Intellectual Property Rights
Members and their guests shall not use the Waterwise Project Ltd’s names, logos, trade marks, service marks, copyright materials or other identifying features without our express prior written permission. No licence is granted or implied by Membership.
17. General
17.1 This contract is between you and us. Nobody else can enforce it.
17.2 You cannot transfer our contract with you to someone else.
17.3 If a court or other authority decides that some of these terms are unlawful, the rest of the terms will continue to apply.
17.4 Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you're not allowed to, but that doesn’t mean we can't do it later.
17.5 Waterwise Individual Membership is non-voting and does not entitle the Member to any legal voting rights, decision-making authority, or ownership in the governance of the organisation.
18. Governing Law
These Terms and Conditions are governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.
